Recently, Joe Bosco and Costa Diamond have successfully made new law in Illinois in persuading the appellate court to find that the innocent insured doctrine applies to the misappropriation exclusion in awarding a woman $176,356 after her husband replaced her 3.57 carat engagement ring with a synthetic demand, finding that she was entitled to coverage as an innocent insured. Dana v. Great Northern Insurance Co. 2024 Ill. App (1st) 230224.
